DEFINITIONS
"Terms" means these terms and conditions;
"Goods" means goods displayed for sale on the Website;
"Users" means the users of the Website collectively;
"User Information" means the details provided by You on any application to buy Goods from us via the Website;
"We/Us/Our" means 20:20 Mobile (UK) Limited;
"Website" means the website located at www.asda-mobile.com or any subsequent URL which may replace it; and
"You/Your" means a user of the Website.

A. PURCHASE OF PRODUCTS
Orders
All orders are subject to acceptance and availability. If the Goods ordered are not available, You will be notified by e-mail (or by other means if no e-mail address has been provided) and You will have the option either to wait until the item is available from stock or to cancel Your order. Any orders placed by You will be treated as an offer to purchase the Goods from Us and We have the right to reject such offers at any time. You acknowledge that any automated acknowledgment of Your order which You may receive from Us shall not amount to Our acceptance of Your offer to purchase Goods. The conclusion of a contract between You and Us will take place when We (i) debit Your credit or debit card or (ii) despatch the Goods to You, whichever is the earlier.
We will take all reasonable care, in so far as it is in Our power to do so, to keep the details of Your order and payment secure, but in the absence of negligence on Our part We cannot be liable for any loss You may suffer if a third party procures unauthorised access to any data provided by You when accessing or ordering from the Website.
Each Good purchased may be sold subject to additional specific terms and conditions related to that Good including, without limitation, terms and conditions concerning estimated delivery times and any warranties. Please ensure that You read such additional terms.

Delivery
Accessory Purchases Only
Order before 12pm for next working day delivery.
For Accessory orders that require alternative delivery arrangements please contact Our Sales Team on 0845 3666990.
For additional security all Accessory orders with a value of £21.00 or more will automatically be sent using Royal Mail's Special Delivery service and will incur a £4.75 delivery cost.
Accessory orders with a value of less than £20.99 will be delivered by Royal Mail, using their 1st Class Signed For service. Although orders are usually received the next working day, please allow up to 5 working days. If delivery is unsuccessful, a card is left to arrange collection or redelivery. Delivery by this method is currently priced at £1.75.
Please note that We are unable to ship to addresses outside of the United Kingdom.
Any orders placed from outside of the United Kingdom will automatically be cancelled.

Cancellation rights
Where You have purchased the Goods as a consumer (i.e. for private use as opposed to business use), please note that You are entitled to cancel any contract completed with Us within 7 working days, beginning on the day after receipt of the Goods. If You do cancel a contract pursuant to this clause, then:
- You must notify Us in writing by sending an e-mail to customerservices@asda-phones.co.uk
or by writing to us at ASDA Phones, Customer Services, 20:20 Mobile (UK) Limited, Weston Road, Crewe, Cheshire CW1 6BU;
- You must retain possession of the Goods and ensure that the Goods are kept in the same condition as they were when they were delivered until such time as the Goods are either collected by Us or delivered back to Us by You;
- We will notify You of when We wish to collect the Goods. The Goods will be collected by Us within 28 days of Our receiving Your cancellation notice and We will charge You the cost of collecting the Goods, and will deduct this from any sum owed by Us to You. Alternatively, You can return the Goods to Us by contacting a customer service operator on 0845 3666 990 who will be able to provide You with address details;
- A copy of the original despatch note must be provided with the returned Goods as proof of purchase and an authorisation number must be obtained prior to return.
- We will refund any monies You have paid to Us (less any costs of collection incurred pursuant to paragraph iii above) within 30 days of receipt of Your cancellation notice.

Price and payment
All prices displayed on the Website are inclusive of VAT (where applicable) at the current rates and are correct at the time of entering the information onto the system. We reserve the right, however, to change prices at any time without notice to You.
Payment can be made by any major credit or debit card, however, We do not accept American Express or Diners Club. Payment will be debited and cleared from Your account before the despatch of Your Goods or provision of the Service to You.
You confirm that the credit or debit card that is being used is Yours.
All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of Your payment card refuses to or does not, for any reason, authorise payment to Us We will not be liable to You for any delay or non-delivery.

Eligibility to purchase
To be eligible to purchase Goods on this Website and lawfully enter into and form contracts on this Website under English law You must:

- stipulate a delivery address in the United Kingdom (excluding the Channel Islands); and
- register Your real name, address, phone number, e-mail address any other details requested.
By offering to purchase Goods You represent to Us that You are 18 years of age or over, you are based in the UK and you authorise Us to transmit information submitted by You (included updated information) to obtain information from third parties, including but not limited to, Your debit or credit card numbers or credit reports to authenticate Your identity, to validate Your credit card, to obtain an initial credit card authorisation and to authorise individual purchase transactions.

B. RETURNS POLICY

In the event that the Goods do not conform with Your order or are faulty on delivery, You may:
- reject the Goods and request a refund of the price in full, provided such rejection is made within 28 (twenty eight) days of purchase and the Goods are returned to Us at ASDA Phones, Customer Services, 20:20 Mobile (UK) Limited, Weston Road, Crewe, Cheshire CW1 6BU with all original components; or
- request a repair or replacement of the Goods provided such request is made within 28 (twenty eight) days of purchase and the Goods are returned to Us at ASDA Phones, Customer Services, 20:20 Mobile (UK) Limited, Weston Road, Crewe, Cheshire CW1 6BU with all original components.
We shall not, however, be liable for any indirect or unpredictable expense arising as a result of such non-conformity or fault, nor will We be liable to repair the Goods where the cost of repair would be disproportionately higher than the cost of replacement (or vice versa).

12-month warranty
All Goods are supplied with a twelve month warranty in the conditions set out by the manufacturer. If the equipment becomes faulty or defective within the warranty period, You must notify Our customer service department and describe the problem(s) they are experiencing.
You must return or arrange with Us to collect the equipment within the warranty period.
The equipment must be returned properly addressed with a returns number previously obtained from Us and provided with adequate protective packaging.
The equipment must be returned along with the despatch note as proof of purchase. If You do not still have the despatch note, We must be satisfied from other evidence that the equipment was purchased by You from Us and that the date of purchase was within 12 months of the claim under this warranty.
You will be responsible for the return of the equipment until it arrives back with Us. If We have arranged to collect the item, You are responsible for it until it is in the possession of our appointed courier.
You are responsible for the cost of returning equipment to Us but this cost shall be refunded in full to You if the equipment is found to be in breach of the warranty. We shall be responsible for the cost of returning or delivering repaired / replacement equipment to You.
This warranty only applies in respect of material faults or defects that are due to faulty design, manufacture or workmanship. No repair or replacement of equipment will be provided if the equipment has been wilfully damaged, misused, neglected, overloaded, modified, adapted or repaired (except as authorised by 20:20 Mobile (UK) Limited).
Equipment returned to Us under this warranty may at Our discretion be either repaired or replaced with equipment of a materially similar specification and condition. Please note that We reserve the right to provide replacements that are reconditioned rather than new.
No repair or replacement of equipment will be provided unless and until all sums due to Us in respect of the equipment have been paid in full by the due date.
The warranty may not extend to consumable items including amongst other things batteries, fuses, etc.
Upon return of repaired equipment or delivery of replacement equipment You may be required to sign as evidence of receipt.
This warranty is offered as an extra benefit and does not affect Your statutory rights.
